Terms of Service

1. Scope

These terms govern use of SmileMore Publisher (the “Application”), an internal publishing tool operated by SMILEMORE MEDIA PTY LTD (ABN 57 692 000 847, “SmileMore Media”). The Application is provided solely for use by authorised SmileMore Media employees. It is not offered to the public, and no public sign-up is available.

2. Authorised use

Employees granted access agree to use the Application only to:

• publish content that SmileMore Media is licensed or authorised to distribute;
• operate YouTube channels for which our partners have granted us manager or owner access; and
• perform publishing tasks in the course of their employment.

Employees must not use the Application to access channels we are not authorised to manage, or to publish content we do not hold rights to.

3. Third-party terms

The Application uses YouTube API Services. Use of the Application is therefore also subject to the YouTube Terms of Service and the Google Privacy Policy. Content published through the Application must comply with YouTube’s Community Guidelines and monetisation policies.

4. Content and rights

SmileMore Media publishes content under licence from rights holders and content partners. Responsibility for the underlying rights to each work rests with the relevant licensing agreement. Localised assets we produce — translations, subtitles, dubbed audio and thumbnails — remain subject to those agreements.

5. Access and revocation

Access to the Application may be granted, limited or withdrawn at any time. Access is revoked when an employee leaves SmileMore Media or when a partner relationship ends. Authorisation can also be withdrawn at any time from the Google Account permissions page.

6. Availability

The Application is provided on an “as is” basis for internal operational use. We make no warranty of uninterrupted availability, and we are not liable for delays or failures arising from third-party services, including the YouTube API.

7. Changes

We may revise these terms from time to time. The revision date above will be updated when we do.

8. Governing law

These terms are governed by the laws of New South Wales, Australia.
